TERMS OF USE (App)

1. Who we are
Fund Hong Limited (“Fund Hong”, “we”, “us”) is a company incorporated in Hong Kong and a money lender licensed under the Money Lenders Ordinance (Cap. 163), licence number 1953/2025. Registered office: Unit 1104, 11/F, Winfield Commercial Building, 6-8A Prat Avenue, Tsim Sha Tsui, Kowloon.
2. These terms
These terms govern use of our website at https://www.fundhong.com/terms-app and, where applicable, access by existing clients to records of facilities we have already granted, including through the application known as “finEm Ledger” (the “App”).
3. The App and finEm Limited
The App is published and operated by finEm Limited (“finEm”) as our technology provider. finEm is not the lender under our facilities and does not underwrite, originate or book loans in our name.
4. Existing clients only
The App does not invite the public to apply for credit, does not originate loans, and does not accept loan applications. Connecting a wallet does not create a loan.
5. Lender of record
Where the App displays a consumer loan, Fund Hong Limited is the lender of record. The wallet linked for that display is the wallet associated with Fund Hong’s borrower.
6. How access works
A client may connect a wallet they control and sign a message so that wallet can be linked to their Fund Hong account. After linking, the App shows that client their own back-office records. Other users cannot open that client’s App record through the App.
7. Public blockchain
Specified ledger fields (including wallet address, KYC-approved flag, numeric identifiers, amounts, rates, dates, token balances and transaction hashes) may be recorded on a public blockchain and may be read by anyone with those public identifiers. Legal name, identity documents, bank details, property address and goods description are not written to the smart contract. Public chain data is generally permanent.
8. Tokens
Any token shown in a wallet is a non-transferable record of a Fund Hong lending relationship. The App is not an exchange.
9. No custody
We do not hold private keys. Clients are responsible for wallet security.
10. Liability
The website and App are provided for information and record-keeping in connection with existing facilities. Nothing on the website is an offer of credit to the public. To the extent permitted by law, we exclude liability for loss arising from wallet compromise, public-chain visibility, or interruption of the App, except where we cannot exclude liability under Hong Kong law.
11. Privacy
Personal data is handled as described in our Privacy Notice at https://www.fundhong.com/pdpo-app.
12. Changes
We may update these terms by posting a revised version on this website.
13. Governing law
These terms are governed by the laws of Hong Kong. The courts of Hong Kong have non-exclusive jurisdiction.
